Article 17.1.4 of the Consitution of Mongolia states that “defending the homeland and performing military service in accordance with the law” are fundamental duties. The following forms of military service are legally recognized:

- Mandatory military service
- Students of military and police schools
- Student soldiers
- Substitute military service
- Contract military service
If a person has not completed their military service by the age of 25, they must either join the military that year or pay a monetary fee. If a person does not attend the military recruitment committee, the fee increases depending on the number of years missed. When the person reaches the age of 26, they may submit a request to replace their service with the specified monetary payment.
By its resolution No.119, dated April 5, 2023, the Mongolian government has set the amount to be paid for replacing military service.
The replacement of military service with a monetary payment can be exempted under the following conditions:
- A man who has been continuously exempted from active military service for several years and has reached maximum age for performing mandatory military service;
- A citizen aged 18 to 25 who has served at least two years in state special services such as the police, intelligence, disaster management, or judicial enforcement;
- A citizen exempted from active militaru service due to health reasons;
A citizen must pay the corresponding amount based on the years they missed before reaching the maximum age for military service, according to the government’s resolution and the specified monetary fee for each year.
The “E-Mongolia Academy” state owned enterprise, has collaborated with the Ministry of Defense and the Military Headquarters of the capital to digitize the service for submitting requests to replace military service with a monetary payment.
